Governance Committee

Each Council across England and Wales must have a Governance Committee, which is responsible for promoting ethical standards within the Council and maintaining high standards of conduct by Councillors. This includes helping Councillors to follow the Local Code of Conduct that exists for each Council.

Redcar & Cleveland Borough Councils Governance Committees main aim is to:
  • promote and create high standards of conduct;
  • improve relationships between Members, Council staff and with members of the public;
  • to be proactive by introducing change rather than reacting to events.

Role and Function

The Governance Committee has the following roles and functions:
  1. Promoting and maintaining high standards of conduct by Councillors, Co-opted Members and Church and Parent Governor representatives;
  2. Assisting the Councillors, Co-opted Members and Church and Parent Governor representatives to observe the Members Code of Conduct;
  3. Advising the Council on the adoption or revision of the Members Code of Conduct;
  4. Monitoring the operation of the Members Code of Conduct;
  5. Advising, training or arranging to train Councillors, Co-opted Members and Church and Parent Governor representatives on matters relating to the Members Code of Conduct;
  6. Granting dispensations to Councillors, Co-opted Members and Church and Parent Governor representatives from requirements relating to interests set out in the Members Code of Conduct;
  7. Dealing with any reports from a case tribunal or interim case tribunal, and any report from the Monitoring Officer on any matter which is referred by an Ethical Standards Officer or the Monitoring Officer;
  8. The exercise of (a) to (g) above in relation to the Parish Councils wholly or mainly in its area and the Members of the Parish Councils;
  9. Oversight of the constitution (in consultation with the Cabinet and Main Scrutiny Committee).

Composition

Membership. The Governance Committee will be composed of at least:

  • Two Councillors other than the Leader
  • One person who is not a Councillor or an Officer of the Council or any other body having a Governance Committee (an Independent Member);
  • Two Members of a Parish Council wholly or mainly in the Councils area (a Parish Member);

Independent Members

Independent Members will be entitled to vote at meetings.

Parish members

Parish Members must be present when matters relating to those Parish Councils or their Members are being considered; Their period of office will be two years.

Sub-committee

The Governance Committee will include two, 3 member sub committees consisting of one independent member chair and two elected members (one elected member to be a parish or town councillor if the matter referred relates to a parish councillor). They will be responsible for conducting assessments of alleged breaches of the Code of Conduct, and for reviewing decisions on alleged breaches of the Code of Conduct.

Chairing the Committee.

A Member of the Executive may not chair the committee.
