If you want to make changes to what is authorised on your premises licence, you will need to apply to vary the licence (full variation).
Variations can include:
- varying the hours during which a licensable activity is permitted
- adding licensable activities
- amending, adding or removing conditions within a licence
- altering the layout of the premises which is shown on the plan
If you want to make minor amendments to what is authorised on your premises licence, you can apply for a minor variation.
Online application forms
Advertise your application (full variation)
Once you have correctly submitted your application for a full variation, you must advertise the application by:
- Displaying a public notice at the premises, and
- Publishing the public notice in a local newspaper (full variations only), and
- Sending the application and plan to the responsible authorities (full variation postal applications only).
More information and guidance on public notices and advertising applications can be found here.
Advertise your application (minor variation)
Once you have correctly submitted your application for a full variation, you must advertise the application by:
- Displaying a public notice at the premises for 10 working days
Further information and guidance on public notices and advertising applications can be found here.
How much should I pay?
For a full variation, the amount you will have to pay will depend on the non-domestic rateable value of the premises. The fees can be found on the GOV.UK Main fee levels web page.
For minor variations, the fee is £89.
Plan of the premises
Your plan of the premises should be drawn to the scale of 1:100 and should include the following:
- The boundary of the premises and any internal and external walls
- The location of points of access and egress from the premises including escape routes
- The location of any fire safety equipment
- Fixed structures (including furniture) or similar objects temporarily in a fixed location (but not furniture) which may impact on the ability of individuals to use exits or escape routes
- The location and height of any stage or raised area
- The location of public conveniences if any
- The location and type of any fire safety or other safety equipment
- The location of a kitchen if any
What happens next
Once a full variation application has been submitted, it is subject to a 28 day consultation where Responsible Authorities and anyone else can make representations about the application.
If there are no representations, the licence is granted as applied for. However, if there are representations, the application will be referred to a licensing sub-committee for determination.
If your application is not advertised correctly, it may be rejected. If this is the case, you will need to start the process from the beginning.
Once a minor variation application has been submitted, it is subject to a 10 working day consultation where Responsible Authorities and anyone else can make representations about the application.
After the consultation, if the authority considers that the variation proposed in the application could not have an adverse effect on the promotion of any of the licensing objectives, it must grant the application. Otherwise, the application will be rejected and the applicant could then choose to apply for a full variation.
