Planning Strategy

This Privacy Notice is designed to help you understand how and why the Planning Strategy Team processes your personal data. This notice should be read in conjunction with the Council’s Corporate Privacy Notice.

Who are we? 

Redcar and Cleveland Borough Council is a ‘Data Controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR). The Planning Strategy Team is responsible for the preparation of the borough’s Local Plan and associated planning policy and conservation and heritage documents.

What personal information do we collect?

We use personal information and comments from individuals and organisations to enable us to carry out specific functions for which we are responsible and to provide you with a service. 

These records may include:

  • Basic details about you, for example; name, postal address, telephone numbers, email address; 
  • Personal & professional opinions given in comments made in relation to planning policy and conservation documents;
  • Details of agents where applicable;
  • Information about your relevant circumstances, where this has been voluntarily disclosed in a response to a consultation;
  • Information about land or property that you have submitted to the planning strategy team for consideration as an allocation in the Local Plan or other planning policy document.

We do not routinely collect information categorised as sensitive, however we may be supplied with information as part of a consultation. Where we are supplied with this information it will be processed only to carry out our legal obligations and in line with data protection policies. 

Why do we collect your personal information? 

We collect the information in the list above primarily to allow us to fulfil the consultation requirements for the preparation of the development plan, its supporting evidence base and associated planning and conservation documents. We keep a register of organisations and individuals who are interested in being kept informed of consultations being held in relation to the preparation of policy documents and retain comments submitted to those consultations in order to fulfil our duties in relation to the preparation of the development plan.

We also keep a register of individuals and groups interested in land within the district for self-build and custom housebuilding and may keep details of landownership for the Strategic Housing and Economic Land Availability Assessment and Brownfield Land Register. These records are also used as evidence to inform the preparation of the Council’s Local Plan and other planning policy related documents.

Who do we share this information with?

We may also need to share information with other organisations. Examples of the organisations we may need to share information with are:

  • the Secretary of State/ Planning Inspectorate to assist in the examination of planning documents.
  • other Tees Valley local authorities to assist in any review of the Tees Valley Joint Minerals and Waste Development Plan Documents, which are prepared jointly with Darlington, Hartlepool, Middlesbrough and Stockton Borough Councils.
  • Third-party service providers appointed to carry out tasks or provide support related to the preparation of planning policy documents on behalf of the Council.

Comments and representations made to a consultation on a planning or conservation document will be made publicly available on the Council’s website and will be included in reports of the consultation. Addresses and contact details will not be published but your name and comments could be. 

How long do we keep your information for?

Your contact details will be kept for a period of 5 years from when you last confirmed that you wanted to be included on the consultation database, unless you request that your information is removed. Information held as a result of comments made to a consultation on a planning policy document will be held for 3 years beyond the life of the document. Processing is kept to a minimum and will only be processed in accordance with the law.

What is our lawful basis for processing your information?

Redcar and Cleveland Borough Council relies on the following lawful basis to process your personal data:

  • UK GDPR Article 6(1)(C) – processing is necessary for compliance with a legal obligation to which the controller is subject. 
  • UK GDPR Article 6(1)(E) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Your Rights

You have a number of rights that you may exercise in relation to your personal data. Some of the rights do not apply automatically and may not be available in certain circumstances where a lawful exception applies. 

  • You have a right to access your personal data. You can request a copy of personal data that we hold about you and ask us to explain how we use your data. 
  • You have a right to object to processing of your personal data. You have an absolute right to stop your data being used for direct marketing. In other cases where the right to object applies, we may be able to continue using your data if we have a compelling reason for doing so. 
  • If we are relying on consent as the lawful basis to process your data you can withdraw your consent at any time, and we will stop further processing. 
  • You have a right to request the restriction or suppression of your personal data. 
  • You have a right to have your personal data erased, if we no longer have a legitimate use for it. This right is sometimes called the ‘right to be forgotten’. 
  • You have a right to rectification of your personal data if the information we hold in relation to you is inaccurate or incomplete. 
  • You have a right not to be subject to any decision based solely on automated processing, including profiling, which produces legal or similarly significant effects. You can request human intervention or challenge any solely automated decision-making that significantly affects you.
